Leitsätze

  1. Die Stundung der Kosten des laufenden Insolvenzverfahrens ist aufzuheben, wenn gegen den Schuldner im Prüfungsverfahren Forderungen i.S.d. § 302 Nr. 1 InsO zur Tabelle festgestellt werden und dem Schuldner auch bei einer gewährten Restschuldbefreiung die Tilgung dieser Verbindlichkeiten offensichtlich nicht möglich ist.

  2. Die Stundung der Kosten des laufenden Insolvenzverfahrens sit aufzuheben, wenn der Schuldner es zumindest grob fahrlässig unterlässt, eindeutige Forderungen nach § 302 Nr. 1 InsO nicht im Insolvenzantrag als auch unter dieser Anspruchsgrundlage geltend gemacht anzugeben.

  3. Auch die unvollständige Angabe von Anspruchsgrundlagen geltend gemachter Forderungen ist eine unrichtige Angabe i.S.d. § 4c InsO.

Tenor
