Omnilex-Zusammenfassung

English insolvency administrator X appealed the Düsseldorf District Court's 10 July 2003 order opening insolvency proceedings over the debtor's assets. The court terminated those proceedings in favor of the proceedings opened before the High Court of Justice in Leeds on 16 May 2003, under Art. 102 § 4(1), first sentence, EGInsO. X had also applied on 8 March 2004 to open secondary insolvency proceedings over the debtor's assets; the court states that these were opened by a separate order under Art. 3(2) EU Insolvency Regulation.

Where the statutory conditions are met, the domestic proceedings are to be terminated in favor of the earlier foreign main proceedings. The termination does not preclude opening secondary insolvency proceedings under Art. 3 Abs. 2 EUInsVO; that question is resolved separately.
