Omnilex-Zusammenfassung

The applicant challenged the Bochum Local Court registrar's refusal of legal aid. The court rejected the reminder, finding it unreasonable to use a lawyer to pursue a claim worth only €0.84. Legal aid must provide equality with a person able to pay for counsel, not fund economically pointless legal work. In addition, the applicant would owe a €10 fee to the lawyer even if legal aid were granted. The court also ordered that extrajudicial expenses would not be reimbursed.

Omnilex-Regeste

§ 1 Abs. 1 Nr. 3 BerHG; legal aid is unavailable where the intended use of counsel is manifestly unreasonable. The scheme seeks to place a person lacking means on an equal footing with a person able to pay for legal assistance; it does not confer an advantage by financing economically pointless legal activity. Whether retaining counsel is reasonable is assessed by asking whether a financially capable person would do so. Pursuing a claim of €0.84 through a lawyer is unreasonable where a prudent self-paying litigant would not incur the cost. The assessment may also account for the applicant's own contribution: where the legal-aid fee payable to counsel is €10, pursuing the aid procedure itself is economically irrational in relation to the claim.

Amtsgericht Bochum

Beschluss

Pursuing the 84-cent claim through a lawyer was economically unreasonable; legal aid was not available.

Legal aid is intended to place a person without means on equal footing with one who can pay for counsel, not to fund economically pointless legal work. A reasonable person would not pay a lawyer to pursue €0.84. The applicant would also owe a €10 legal-aid fee, exceeding the claim.

Extrajudicial expenses are not reimbursed.
