No entitlement to renewed advice after consulting the authority

Omnilex-Zusammenfassung

The applicant challenged the denial of legal aid for advice concerning an ARGE decision. The Bochum Local Court rejected the reminder as unfounded. It held that, after the applicant had already received advice from the ARGE, disagreement with that authority’s view did not establish entitlement to another stand-alone consultation under the Legal Advice Assistance Act. The applicant could instead object to or appeal the decision as indicated in its notice and, if legal or factual difficulties warranted it, obtain legal aid to support that challenge. The court also ordered that extrajudicial expenses would not be reimbursed.

Omnilex-Regeste

§ 1(1) no. 2 BerHG; other available advice and access to legal advice assistance. Advice already obtained from the competent authority generally constitutes another advice possibility within the meaning of the provision. A person who disagrees with the authority’s legal assessment must ordinarily challenge the resulting decision through the available objection or appeal procedure; disagreement alone does not create an entitlement to repeat the consultation under legal advice assistance. Legal aid may, however, be available to support the challenge, particularly where legal or factual difficulties arise. Whether an alternative advice possibility is sufficient depends on the circumstances; only exceptional cases may justify treating the possibility of obtaining information from an authority as unavailable.

Tenor

A further consultation alone was not justified; the applicant could challenge the ARGE's decision and seek legal aid to prepare that challenge if needed.

Having already received advice from the ARGE, the applicant was expected to use the objection or appeal procedure stated in the decision notice. Legal aid could be sought to support that challenge, particularly where legal or factual difficulties arose, but not for a repeat consultation alone.
