Omnilex-Zusammenfassung

The applicant’s reminder against the clerk’s 15 March 2007 cost determination was admissible and well-founded. Bochum Local Court held that the applicant was entitled to a completion fee under § 132 III BRAGO. It reasoned that an administrative matter is concluded whether the authority formally withdraws the challenged recovery notice or leaves an objection undecided for more than four years, allowing the claim in the administrative act to become time-barred. The court set aside the cost determination and directed the clerk to reconsider the applicant’s request under the court’s legal view. No out-of-court expenses were reimbursed, and no appeal was admitted.

Omnilex-Regeste

§ 132 III BRAGO; § 56 RVG; entitlement to a completion fee where an administrative matter is concluded. For the completion fee, it is immaterial whether the authority formally withdraws the contested recovery decision or leaves an objection undecided for a prolonged period, with the result that the claim established in the administrative act becomes time-barred. In either situation, the administrative matter is concluded within the meaning of § 132 III BRAGO. A conclusion of the matter is therefore not confined to formal termination by the authority; it may also follow from the practical and legal consequences of prolonged administrative inaction. The reminder under § 56 RVG is well-founded where the cost determination fails to recognize that fee entitlement.

Tenor

The applicant was entitled to the completion fee because the administrative matter was concluded when the claim became time-barred after prolonged failure to decide the objection.

Formal withdrawal of the recovery notice and prolonged failure to decide an objection, resulting in limitation of the claim, do not differ for purposes of whether the administrative matter has been concluded.

The cost determination was set aside, and the clerk was directed to reconsider the applicant’s request in accordance with the court’s legal view.

The applicant was entitled to the completion fee, so the existing determination could not stand.
