Whether multiple maintenance legal-aid requests constitute one matter

Omnilex-Zusammenfassung

The applicant sought legal advice and assistance in proceedings concerning modification of a judicial maintenance settlement dated 20 July 2004, with claims involving his former wife and three children. The court held that these related requests constituted one matter for legal-aid and fee purposes. It noted that assistance had been granted in related proceeding 52 II 3678/06 by a decision issued the same day. Finding the reminder against the denial in this proceeding admissible but unfounded, the Bochum District Court rejected it and ordered that extrajudicial expenses would not be reimbursed.

Omnilex-Regeste

Sections 11 and 24a RpflG and section 6(2) BerHG; unity of matter in legal-aid and fee law. Requests for advice and assistance concerning modification of a single judicial maintenance settlement, even where directed against several maintenance creditors and pursued in separate proceedings, may constitute one matter. The relevant inquiry is whether the requests concern the same substantive subject. Section 16 no. 4 RVG, which expressly treats divorce proceedings and their ancillary matters as one matter, confirms this assessment. Accordingly, separate applications relating to the same modification do not, merely because they involve different creditors or file numbers, necessarily constitute separate matters.

Tenor
