Tenor

Im Wege der einstweiligen Verfügung wird auf Grund des dem Beschluss beigefügten Antrages und der Schreiben vom 07.12.12, 10.12.12, 05.03.13, 30.04.13, 13.05.13 und des Auftrags vom 25.01.13 gemäß § 46 I TKG und wegen der Dringlichkeit des Falles ohne vorangegangene Verhandlung angeordnet:

Der Antragsgegnerin wird aufgegeben, die Kommunikationsdienstleistungen zu dem Anschluss im Haus des Antragstellers in F-straße #, ##### T im Umfang des von der Antragsgegnerin vertriebenen Kommunikationspaketes T-Net + Call & Surf Comfort umgehend, spätestens binnen 5 Werktagen nach Erhalt der Verfügung, freizuschalten.

Der Antragsgegnerin wird im Fall der Zuwiderhandlung angedroht:

  • die Festsetzung eines Ordnungsgeldes in Höhe von bis zu 250.000,00 EUR ersatzweise für den Fall, dass dieses nicht beigetrieben werden kann, die Anordnung von Ordnungshaft

oder

  • die Anordnung unmittelbarer Ordnungshaft von bis zu 6 Monaten, bei mehreren oder wiederholten Zuwiderhandlungen bis zu insgesamt zwei Jahren.

Die Kosten des Verfahrens werden der Antragsgegnerin auferlegt.

Der Verfahrenswert wird auf bis 1.200 EUR Euro festgesetzt.
