Omnilex-Zusammenfassung

Company Q applied for comprehensive access to files containing leniency applications and information voluntarily provided by leniency applicants to a national competition authority in cartel fine proceedings. The Bonn Local Court stayed the proceedings and referred a question to the Court of Justice of the European Communities. It asked whether EU competition law, particularly the rules on cooperation between competition authorities and the effective enforcement of competition rules, bars cartel victims from obtaining such materials when seeking to assert civil claims.

The compatibility with EU competition law of granting victims access to leniency applications and supporting information voluntarily supplied to a national competition authority in cartel proceedings is referred for interpretation. The reference concerns the relationship between cooperation within the European Competition Network, the protection and effectiveness of leniency programmes, and the ability of injured parties to pursue civil damages claims. The referring court stays the proceedings pending the Court of Justice’s ruling.
