Omnilex-Zusammenfassung

In this partial judgment, the Bonn District Court dismissed the plaintiff’s claim against Defendant 2. The dispute concerned a contract to install parquet flooring and whether the resulting obligation could bind the other spouse under BGB § 1357. The court held that furnishing a home with parquet is not a transaction that one spouse ordinarily undertakes alone, so the provision did not apply. The plaintiff was ordered to bear Defendant 2’s extrajudicial costs; the remaining costs decision was reserved for the final judgment. The judgment was provisionally enforceable, subject to security.

Omnilex-Regeste

BGB § 1357; furnishing a dwelling with parquet flooring is not a transaction ordinarily undertaken by one spouse alone. The statutory power of representation for transactions serving the appropriate coverage of family needs does not extend to commissioning such work. Accordingly, a spouse who commissions parquet installation cannot bind the other spouse on that basis.
