Omnilex-Zusammenfassung

The Bonn Local Court announced the debtor’s residual debt discharge subject to compliance with the duties under § 295 InsO during the assignment period and the absence of grounds for denial under §§ 297–298 InsO. The debtor’s assignment of 4 August 1999 transfers attachable employment-related payment claims to the existing trustee. The assignment runs for five years from termination or discontinuance of the insolvency proceedings. The trustee performs the statutory functions under §§ 291–292 InsO. The court rejected the application to deny discharge and ordered the applicant to bear the costs caused by that application.

Omnilex-Regeste

§§ 291–298 InsO; announcement of residual debt discharge and duties during the assignment period. The announcement of discharge is conditional: the debtor must comply with the duties under § 295 InsO, and no statutory ground for denial under §§ 297 or 298 InsO may exist. Under § 291 Abs. 2 and § 292 InsO, the trustee performs the statutory functions during the relevant period. The assignment of attachable claims to the trustee begins upon termination or discontinuance of the insolvency proceedings and lasts five years pursuant to Art. 107 EGInsO. The announcement is therefore not an unconditional discharge; discharge depends on the debtor’s subsequent conduct and the absence of a statutory denial ground.
