Omnilex-Zusammenfassung

Following an accident on 28 May 2010, the plaintiff sought recovery from the defendants of employer contributions and related expenses. The Kerpen Local Court held that employer pension, accident-insurance, and liability-insurance contributions are transferable claims: they are not employee-earned remuneration, and their public-law basis supports treating them alike for damages purposes. It ordered the defendants jointly and severally to pay €3,121.26 with interest from 1 February 2011 and to release the plaintiff from €302.10 in net pre-litigation legal fees. It rejected the VAT component of those fees, charged the defendants with the costs, and granted leave to appeal concerning €181.64.

Omnilex-Regeste

Section 6(1) EFZG; transferability of employer contributions as damages claims. Employer contributions to pension insurance do not constitute remuneration earned by the employee. The employer's payment obligation arises from public-law provisions, and the contributions serve to maintain the capacity of social-insurance systems. Accident-insurance contributions are therefore not to be treated differently from the contributions expressly addressed in section 6(1) EFZG; all are transferable claims. Employer-paid liability-insurance premiums are likewise transferable: they are intended to benefit the employee and, on normative damages principles, are not materially distinguishable from employer contributions to social-insurance systems. This approach follows the Federal Social Court's treatment of pension contributions and departs from contrary Federal Court of Justice precedents.

Leitsätze

  1. Die Arbeitgeberbeiträge zur Rentenversicherung stellen kein vom Arbeitnehmer erwirtschaftetes Entgelt dar (Anschluss an BSG, Urteil vom - B 4 RA 57/98 R, BSGE 86, 262 = NZS 2001, 370; gegen BGH, Urteil vom 16.11.1965 - VI ZR 197/64 - NJW 1966, 199 und Urteil vom 11.11.1975 - VI ZR 128/74 - NJW 1976, 326).
