Tenor
Die Beklagte wird verurteilt, an die Klägerin ein Schmerzensgeld von 750 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem xx. xx. xxxx zu zahlen.
Es wird festgestellt, dass die Beklagte verpflichtet ist, der Klägerin sämtliche materiellen Schäden zu ersetzen, die ihr aus der unterbliebenen Erkennung des Kariesbefalls der Zähne 15 und 25 am xx. xx. xxxx und des hierdurch bedingten Verlustes dieser beiden Zähne resultieren, soweit diese Ansprüche nicht auf Sozialversicherungsträger oder Dritte übergegangen sind.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits einschließlich des Beweissicherungsverfahrens 10 H 10/03 werden gegeneinander aufgehoben.
Das Urteil ist vorläufig vollstreckbar. Die Parteien können die Zwangsvollstreckung gegen Sicherheitsleistung in Höhe von 110 % des aus dem Urteil zu vollstreckenden Betrages abwenden, sofern nicht die Gegenpartei in gleicher Höhe Sicherheit leistet.
