The Obergericht, I. Zivilkammer, held that the daughters of former spouses were not entitled to request clarification of their parents' divorce judgment under Art. 334 ZPO because they were neither parties, intervening parties, nor successors. As third parties, they also lacked standing to bring an appeal. The court therefore did not enter into the complaint. It additionally noted that the lower court's remedy information was incomplete: while the clarification decision itself is appealable, a granted clarification restarts the time limit for the correct main remedy, which would otherwise have been an appeal.
Art. 334 ZPO; standing to request clarification of a judgment. A request for clarification may be filed only by the parties, intervening parties, or successors; third parties lack standing. Where the clarification applicant is not entitled to seek clarification, it likewise lacks standing to challenge the clarification decision by remedy. If clarification is granted, the time limit for the proper main remedy runs anew against the new first-instance decision; the appeal under Art. 334 para. 3 ZPO is directed only against the decision on clarification, not against the substantive remedy that becomes available against the clarified judgment (consid. 5).

Ein Gesuch um Erläuterung kann von den Parteien, Nebenparteien oder Rechtsnach- folgern eingereicht werden; nicht jedoch von Dritten. Die Töchter der ehemaligen Scheidungsparteien verlangten vor Vorinstanz die Er- läuterung des Scheidungsurteils.
