Analog zu den Betreibungs- und Arrestkosten sowie entsprechend der Ordnung von ZPO 67 Abs. 4 und ZPO 76 dürfen die Kosten des zweitinstanzlichen Verfahrens aus dem Vorschuss bezogen werden, unabhängig vom Ausgang des Rechtsmittels, unter gleichzeitiger Einräumung des Rückgriffs gegen die unterliegende Gegenpartei. Für das Einspracheverfahren gilt im Grundsatz die allgemeine Kosten- und Entschädigungspflicht der unterliegenden Partei.

(Die Arresteinsprache wird im summarischen Verfahren behandelt, SchKG 25 Ziff. 2 lit. a, und das gilt auch für den Weiterzug. Demnach ist der Rekurrent vorschusspflichtig, GebVSchKG [48 und] 49. Analog zu den Betreibungs- und Ar- restkosten [SchKG 68 und 281 Abs. 2] und gleich wie nach ZPO 67 Abs. 4 oder beim Kostenbezug in den Fällen der Kaution nach ZPO 76 bezieht das Oberge- richt die Kosten ungeachtet des Verfahrensausgangs aus dem Vorschuss und räumt dem Rekurrenten gegebenenfalls den Rückgriff ein. - Hier hatte der Einzel- richter die Einsprache des Arrestschuldners gutgeheissen. Der Gläubiger erhob Rekurs und leistete dem Obergericht den verlangten Kostenvorschuss. Der Re- kurs war erfolgreich; der Arrest wurde bestätigt.) "2.Für das Einspracheverfahren wird der Beklagte als unterliegende Par- tei nach der allgemeinen Regel kosten- und entschädigungspflichtig.
