The Obergericht held that the paritarian conciliation authority under Art. 200 Abs. 1 ZPO does not govern disputes from agricultural leases. For such disputes, the justice of the peace must be seized first, and the tenancy court thereafter, because Art. 200 ZPO covers only tenancy and lease of residential and commercial premises. The court further noted that, although cantons could extend the paritarian conciliation model to agricultural leases, the Canton of Zurich had not done so.
Art. 200 Abs. 1 ZPO; agricultural lease disputes are excluded from the paritarian conciliation procedure. Art. 200 ZPO follows the terminology of the OR and is limited to disputes arising from lease and tenancy of residential and commercial premises. Agricultural leases under the LPG are a distinct category within the meaning of Art. 276a Abs. 2 OR. Cantons may extend paritarian conciliation to such disputes, but absent an express cantonal rule the ordinary conciliation authority (justice of the peace) and thereafter the tenancy court remain competent (consid. 2).

In Streitigkeiten aus landwirtschaftlicher Pacht ist zuerst der Friedensrichter und hernach das Mietgericht anzurufen (Art. 47 LPG i.V.m. Art. 197 f. ZPO und § 57 GOG bzw. § 21 Abs. 1 lit. b GOG). Die Zuständigkeit des Friedensrichters (anstatt der paritätischen Schlichtungsbehörde in Miet- und Pachtsachen) ergibt sich daraus, dass Art. 200 ZPO (welcher eigentlich nur aArt. 274a OR ersetzt, vgl. Botschaft zur eidgenössischen ZPO S. 7330) mit den "Streitigkeiten aus Miete und Pacht von Wohn- und Geschäftsräumen" die Terminologie des OR übernimmt (vgl. auch Honegger in: Sutter-Somm/Hasenböhler/Leuenberger, ZPO Komm., 2. Aufl. 2013, Art. 200 N 3). Gemäss Art. 276a Abs. 2 OR ist zwischen der Miete und Pacht von Geschäftsräumen und der landwirtschaftlichen Pacht (gemäss LPG) zu unterscheiden, auch wenn von der landwirtschaftlichen Pacht rein begrifflich oft auch Wohn- und Geschäftsräume erfasst sind. Zwar stünde es den Kantonen frei, der paritätischen Schlichtungsbehörde in Miet- und Pachtsachen auch die Schlichtung von Streitigkeiten aus landwirtschaftlicher Pacht zu unterstellen, doch hat dies der Kanton Zürich in § 66 GOG nicht getan, weshalb § 57 GOG greift (Hauser/Schweri/Lieber, GOG-Kommentar, § 66 N 1).
