Zusammenfassung

In a written presiding order, the Obergericht clarified that under Art. 29(1) ZPO a procedural representative can only be a natural person. Claudio G., who had been authorized by the plaintiff, cannot be described as acting as an organ of G. + H. AG in the lawsuit. He may, however, be designated with a c/o reference at the company address for service purposes.

Regest

Art. 29 Abs. 1 ZPO; person of the representative in proceedings: the procedural representative must be a natural person. A legal entity cannot itself act as representative through its organ; the organ acts only as an individual person. Service may nevertheless be effected at the business address by an appropriate c/o designation. The formal designation of the representative must be clarified accordingly (consid. unspecified).

Gesamter Gesetzestext
