Zusammenfassung

The applicants, K.S. and K.S. AG, complained before the European Commission of Human Rights that Switzerland had breached the presumption of innocence in tax-fraud proceedings. They argued that the tax authorities were required not only to prove undeclared income, but also to prove negatively that no tax-reducing or tax-exempting facts existed. The Commission held that this evidentiary rule did not violate Article 6 § 2 ECHR and declared the application inadmissible.

The Convention does not forbid an allocation of the evidentiary burden that leaves it to the accused to rely on circumstances reducing or excluding tax liability, provided no impermissible presumption of guilt is created.

Présomption d'innocence dans une procédure pénale pour fraude fiscale.

Art. 6 § 2 CEDH.

La répartition du fardeau de la preuve selon laquelle il incombe aux autorités fiscales de prouver que des éléments de revenu n'ont pas été déclarés, sans devoir pourtant apporter la preuve négative de l'absence de faits entraînant une réduction ou une exonération d'impôt, ne viole pas cette disposition.
