The European Commission of Human Rights declared inadmissible the application by B. S., an Indian Sikh from Punjab, challenging his asylum-related removal from Switzerland. Art. 3 CEDH. Aucune violation dans un cas où un Sikh indien du Pendjab n'a pas établi à satisfaction de droit en quoi son retour dans une autre région de l'Inde l'exposerait à un danger.
Art. 6 § 1 CEDH. Le droit d'accès à un tribunal ne vaut pas pour une décision de renvoi prise après le rejet d'une demande d'asile, car cette affaire n'est ni de nature civile ni de nature pénale (rappel de la jurisprudence publiée dans JAAC 51.71 [1987]).
Art. 13 CEDH. Le recours administratif contre la décision en matière d'asile ouvert à l'époque auprès du DFJP satisfaisait à cette disposition (rappel de la jurisprudence publiée dans JAAC 51.88 [1987]).
Asyl. Art. 3 EMRK. Keine Verletzung in einem Fall, in welchem ein indischer Sikh aus dem Punjab nicht genügend dargetan hatte, inwiefern ihm bei seiner Rückkehr in eine andere Gegend Indiens Gefahr droht.
Art. 6 § 1 EMRK. Der Anspruch auf Zugang zu einem Gericht gilt nicht für eine Wegweisungsverfügung nach abgewiesenem Asylgesuch, da diese Sache weder zivil- noch strafrechtlicher Natur ist (Bestätigung der in VPB 51.71 [1987] publizierten Rechtsprechung).
Art. 13 EMRK. Die im damaligen Zeitpunkt gegen den Asylentscheid mögliche Verwaltungsbeschwerde an das EJPD genügte den Anforderungen dieser Bestimmung (Bestätigung der in VPB 51.88 [1987] publizierten Rechtsprechung).
