Omnilex-Zusammenfassung

B. G. complained that the criminal proceedings did not satisfy the Article 6 § 1 ECHR guarantee of a tribunal established by law because the Federal Court’s indictment chamber, relying on Article 263(3) PPF, departed from the ordinary venue rules of Article 350 SCC in a case involving concurrence of offences. The European Commission of Human Rights held that Article 6 § 1 requires judicial organization to be set by formal law, but not in exhaustive detail, and found that the deviation had reasonable grounds. The application was declared inadmissible.

Omnilex-Regeste

Art. 6 § 1 ECHR; guarantee of a tribunal established by law: the judicial organization must rest on a formal legal basis and may not depend on executive discretion, but the legislature need not regulate every organizational detail so long as it defines the framework of the judicial system. A departure from ordinary venue rules in criminal matters does not breach this guarantee where the competent authority has reasonable grounds, in particular in cases of concurrence of offences and a statutory exception to the normal forum rule (consid. 1-2).

Art. 6 § 1 CEDH.

Kernrechtsfrage

Whether Article 6 § 1 ECHR requires criminal court organisation to be fixed in formal law and not left to executive discretion.

Extrahierter Entscheid

Article 6 § 1 requires the judicial organization to be based on formal law and not on executive discretion, but the law need not regulate every detail if it sets the organizational framework.

Extrahierte Begründung

The Commission accepted that a formal legal basis suffices for the 'tribunal established by law' guarantee; complete detail is unnecessary where the statute defines the structure of the judicial system.

Kernrechtsfrage

Whether the Commission should find a violation because the Federal Court’s indictment chamber departed from the ordinary venue rules under Article 263(3) PPF and Article 350 SCC.

Extrahierter Entscheid

No violation was found; the chamber had reasonable grounds to depart from the ordinary rules on venue for prosecution and judgment.

Extrahierte Begründung

In a case of concurrence of offences, the deviation from the ordinary venue rules was considered justified and compatible with Article 6 § 1.
