Art. 6 § 2 CEDH. Présomption d'innocence.

La simple présence, dans un dossier pénal, de l'enregistrement illégal d'une conversation téléphonique étayant la culpabilité de l'accusé ne suffit pas pour admettre que le tribunal criminel ait traité celui-ci en présumé coupable avant de le condamner.

Die Tatsache allein, dass die Akten eines Strafprozesses die illegale Aufzeichnung eines Telefongesprächs enthielten, welches den Angeklagten als schuldig erscheinen lässt, genügt nicht, um anzunehmen, dass das Strafgericht den Angeklagten als vermutlich Schuldigen vor der Verurteilung behandelt habe.
