Kernrechtsfrage
Whether the ward could appeal the ratification of the succession-sharing agreement without the legal guardian’s consent
Extrahierter Entscheid
The appeal was not validly perfected because the challenged decision did not concern a strictly personal right and the legal guardian did not ratify the appeal.
Extrahierte Begründung
Under Article 19(2) CC, an interdicted person capable of discernment may act alone only in strictly personal matters. A succession partition of real estate, cash, and securities is not such a matter; therefore the ward could initiate the appeal only with the legal representative’s approval. Since the appeal was signed only by the ward and the guardian expressly refused consent, it was inadmissible.
