W.________, acting on behalf of J.________, appealed a non-entry order issued by the Lausanne public prosecutor. Before the appeal was decided, he withdrew it in writing. The Chamber of Criminal Appeals took formal notice of the withdrawal, removed the case from the docket, and held that the costs of CHF 220 would exceptionally be borne by the State despite the general rule that the withdrawing party is deemed to have lost.
Art. 386 al. 2 let. b CPP; withdrawal of an appeal and procedural consequences. When an appellant expressly withdraws the appeal, the appellate court takes note of the withdrawal and strikes the case from the docket without examining the merits. Under Art. 428 al. 1 CPP, the withdrawing party is in principle deemed to have lost and bears the costs; however, the court may exceptionally depart from that rule and leave the costs to the State where the circumstances justify such a solution (consid. 1-2).

Art. 386 al. 2 let. b CPP La Chambre des recours pénale prend séance à huis clos pour statuer sur le recours interjeté le 22 février 2014 par W., agissant au nom de son pupille, J., contre l’ordonnance de non-entrée en matière rendue le 4 février 2014 par le Ministère public de l’arrondissement de Lausanne dans la cause n° PE14.001453-LCT. Elle considère en fait et en droit : 1.Par avis du 27 février 2014, le Président de la Chambre des recours pénale a imparti à W.________ un délai au 19 mars 2014 pour effectuer un dépôt de 440 fr. à titre de sûretés.
2 - Par écriture du 3 mars 2014, W.________ a déclaré retirer le recours qu’il avait interjeté le 22 février 2014 contre l’ordonnance de non- entrée en matière rendue le 4 février 2014 par le Ministère public de l’arrondissement de Lausanne. Il sied d’en prendre acte et de rayer la cause du rôle. 2.La partie qui retire son recours étant considérée comme ayant succombé (art. 428 al. 1, 2 e phrase CPP [Code de procédure pénale du 5 octobre 2007; RS 312.0]), les frais de la procédure de recours, constitués en l'espèce du seul émolument d'arrêt, par 220 fr. (art. 20 al. 1 TFJP [tarif des frais judiciaires pénaux du 28 septembre 2010; RSV 312.03.1]), devraient en principe être mis à la charge de W.________. Compte tenu des circonstances exposées par le recourant, ils seront exceptionnellement laissés à la charge de l’Etat. Par ces motifs, la Chambre des recours pénale, statuant à huis clos, prononce : I. Il est pris acte du retrait du recours. II. La cause est rayée du rôle. III. Les frais d'arrêt, par 220 fr. (deux cent vingt francs), sont laissés à la charge de l’Etat. IV. Le présent arrêt est exécutoire. Le président : La greffière :
3 - Du L'arrêt qui précède, dont la rédaction a été approuvée à huis clos, est notifié, par l'envoi d'une copie complète, à : -M. W.________, -Ministère public central, et communiqué à : -M. le Procureur de l’arrondissement de Lausanne, par l’envoi de photocopies. Le présent arrêt peut faire l'objet d'un recours en matière pénale devant le Tribunal fédéral au sens des art. 78 ss LTF (loi du 17 juin 2005 sur le Tribunal fédéral – RS 173.110), cas échéant d'un recours constitutionnel subsidiaire au sens des art. 113 ss LTF. Ces recours doivent être déposés devant le Tribunal fédéral dans les trente jours qui suivent la notification de l'expédition complète (art. 100 al. 1
