The appellant challenged the State Council's approval of the zoning plan for Fusio (now Lavizzara), but withdrew the appeal at the hearing of 14 September 2005. The Tribunal of the Planning of the Territory therefore struck the case from the docket on 16 September 2005 and ordered that no fees or costs be charged.
Withdrawal of the appeal before the cantonal planning court; effect on proceedings and costs: where the appellant withdraws the appeal during the hearing, the proceeding is exhausted and the court removes the matter from the docket. In the absence of a substantive decision on the merits, no court fees or costs are levied.

la risoluzione 18 marzo 2003, n. 1181, con cui il Consiglio di Stato ha approvato il piano regolatore del comune di Fusio (ora Lavizzara);
preso atto che, in occasione dell'udienza del 14 settembre 2005, il ricorrente ha dichiarato di ritirare il ricorso;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
