Zusammenfassung

The appellant company challenged the State Council's approval of a detailed plan. Before the court decided the merits, its lawyer informed the Tribunal of Planning that the appeal was withdrawn. The court held that the proceeding had therefore become moot and ordered the case removed from the docket. It further decided that no court fees or expenses would be charged.

Withdrawal of an appeal before the Tribunal of Planning renders the proceeding devoid of object; the court must strike the case from the docket. In such circumstances, and absent any indication to the contrary, no fees or costs are charged (consid. 1-2).
