Zusammenfassung

The appellants challenged the Cantonal Government's approval of a municipal zoning plan before the Tribunal of Territorial Planning. At the hearing of 11 September 2002, their representative withdrew the appeal. The court therefore struck the case from the docket and ordered that no court fees or expenses be levied. The decision was issued by President Raffaello Balerna, assisted by secretary Fiorenzo Gianinazzi.

Withdrawal of appeal before the court of review; strike-out of the proceedings and no allocation of court costs. Where the appellants withdraw the challenge at the hearing, the court has no cause to rule on the merits and removes the case from the roll; in such circumstances, it may dispense with the levying of fees and expenses (consid. 1-2).
