Zusammenfassung

The appellants challenged the Cantonal Government’s approval of a municipal zoning plan before the Tribunal of territorial planning. Before the court could decide the merits, the appellants’ representative withdrew the appeal by letter dated 30 September 2002. The court therefore found the case moot, struck the appeal from the docket, and ordered that no court fees or expenses be charged.

Mootness following withdrawal of the appeal; where the appellant unequivocally withdraws the recourse, the court strikes the matter from the roll and, absent special circumstances, refrains from levying court fees and expenses (consid. 1-2).
