Zusammenfassung

The appellant challenged a decision of the Ticino Cantonal Government approving a zoning-plan variant concerning the inventory of buildings outside the building zone. After the case file had been exchanged and the hearing held, the appellant withdrew the appeal on 1 September 1999. The Tribunal of the Planning of the Territory therefore found that the case had become moot, struck the appeal from the docket, and ordered that no court fees or costs be collected.

Withdrawal of an administrative appeal renders the proceedings moot; the deciding court may strike the case from the docket and, absent special circumstances, refrain from levying court costs. The dispositive issue is not the merits of the challenged administrative act, but the absence of a live controversy after the appellant renounces the challenge.
