The appeal against the State Council's approval of a detailed zoning plan was withdrawn by the appellant by letter of 19 January 2001. The Tribunal of the planning of the territory therefore held that the case had become moot, struck the appeal from the docket, and ordered that no fees or costs be charged. The decision was issued in Lugano on 23 January 2001.
Appeal withdrawn and case devoid of object; proceedings are struck off the roll. Where the appellant withdraws the challenge before judgment, the court need not examine the merits and may declare the proceedings without object. In such a situation, the court may dispense with fees and costs (consid. 1-2).
