statuendo sul ricorso del 12 settembre 1996 di

avv. __________ __________, __________,

contro

la risoluzione governativa del 9 luglio 1996 in materia di inventario degli edifici fuori della zona edificabile nel Comune di __________;

considerato in fatto e diritto:

che il tribunale procede, d’ufficio o su richiesta di una parte, allo stralcio dei ricorsi che nel corso del procedimento diventano privi di oggetto, rispettivamente di interesse giuridico;

che a norma dell’art. 28 LPamm, applicabile in forza del richiamo dell’art. 38 cpv. 6 LALPT, il TPT può applicare alle proprie decisioni una tassa di giustizia alla parte soccombente e, giusta l’art. 31 LPamm, condannarla al pagamento di un’indennità alla controparte;

che soccombente è in linea di principio l’autorità che rivede nel senso postulato dal ricorrente la decisione impugnata (acquiescenza), rispettivamente il ricorrente che ritira il gravame (desistenza) o comunque si assoggetta, espressamente o implicitamente alla decisione impugnata;

che il Comune di __________ aveva omesso nell’inventario degli edifici fuori dalle zone edificabili, approvato dal Consiglio di Stato con la risoluzione 9.7.1996, l’edificio n. __________di proprietà di __________ __________, il quale è insorto presso il TPT col ricorso in epigrafe, dolendosi di tale omissione;

che il Comune ha successivamente inserito il rustico in discorso nell’inventario, riportandolo erroneamente col numero di mappa 226 anziché 224; errore corretto a seguito di ricorso al Consiglio di Stato che ha approvato la tabella delle valutazioni e le modifiche nel senso postulato dal ricorrente con risoluzione 18.8.1998;

che in tal modo la vertenza è divenuta senza oggetto;

che soccombente, in queste circostanze, è il Comune il cui errore ha indotto __________ __________ a ricorrere;

che il Comune deve di conseguenza versare congrue ripetibili al ricorrente, avvocato in re propria, mentre nella sua qualità di ente pubblico agente nell’esercizio delle sue funzioni istituzionali va esente da tasse di giudizio;

Per questi motivi,

dichiara e pronuncia

  1. Il ricorso é stralciato dai ruoli.

  2. Non si prelevano tasse di giudizio. Il Comune di __________ verserà al ricorrente fr. 800.-- a titolo di ripetibili per le due istanze.
