Zusammenfassung

The appellant challenged the State Council’s approval of a municipal zoning plan but withdrew the appeal at the hearing on 12 September 1996. The Planning Tribunal held that the case had become moot and struck the appeal from the docket. It also ordered that no court fees or costs be collected. The decision was issued by the Tribunale della pianificazione del territorio in Lugano.

Appeal withdrawn during the hearing; proceedings become moot and are struck from the docket. When the appellant withdraws the challenge, the court need not decide the merits; it may simply remove the case from the roll. In such circumstances, and absent contrary indications, no fees or costs are levied (consid. 1-2).
