considerato che il ritiro del ricorso vale desistenza e dunque soccombenza della ricorrente sicché si giustifica, a norma dell'art. 31 LPAm richiamato dall'art. 38 cpv. 6 LPAm, l'assegnazione di ripetibili al convenuto che peraltro ne ha fatto debita istanza; con l'avvertenza che la complessità e particolarità della materia hanno comportato il ricorso all'assistenza di uno specialista, ossia spese personali particolari di cui va equamente tenuto conto;
