  1. __________, nato nel 1956, domiciliato a __________, lavora alle dipendenze della __________ in qualità di steward. La sua sede di lavoro è a __________. Nella dichiarazione d’imposta IC/IFD 1995-96 il contribuente ha chiesto una deduzione per spese di trasporto di fr. 13’200.-- di media annua, per recarsi dal luogo di domicilio a quello di lavoro, oltre alla deduzione per doppia economia domestica di fr. 8’400.--. L’ Ufficio di tassazione gli ha invece riconosciuto solo parzialmente quella per le spese di trasporto e, meglio, nella misura di fr. 3’300.--, pari al costo dell’abbonamento generale delle FFS, poiché il contribuente già beneficia della deduzione per doppia economia domestica e per le spese di alloggio sul luogo di domicilio (cfr. decisione su reclamo dell’ 11 luglio 1995).

  2. Con il presente, tempestivo ricorso __________ chiede la deduzione integrale delle spese di trasporto con il mezzo privato per un importo di fr. 13’200.-- di media annua, come gli sarebbero state concesse in passato.

  3. All'udienza dell'8 maggio 1996, tenuto conto delle spiegazioni del ricorrente, che ha precisato di non disporre di un appartamento a __________ ma di dormire in albergo quando gli orari di lavoro non gli consentono di rientrare in Ticino, le parti hanno convenuto, su proposta del Presidente della Camera, di aumentare la deduzione per spese di trasferta di fr. 3'000.– tanto per l'IC quanto per l'IFD.

Per questi motivi,

visti per le spese gli art. 144 LIFD e 231 LT 1994

dichiara e pronuncia

  1. Il ricorso è parzialmente accolto.

§ Di conseguenza, la decisione su reclamo dell'11 marzo 1996 è riformata nel senso che la deduzione per spese di trasferta è aumentata di fr. 3'000.–.

  1. Non si prelevano né tassa di giustizia né spese.

  2. Intimazione alle parti.

  3. Per l'IC il presente giudizio è definitivo (art. 230 cpv. 3 LT 1994).

Per l'IFD è ammesso il ricorso entro 30 giorni al Tribunale federale in Losanna (art. 146 LIFD).
