In a tax appeal concerning the quantification of a legal mortgage, the appellants withdrew their appeal by letter dated 1996-02-06. The Camera di diritto tributario therefore held that the matter had become moot and ordered the appeal struck from the docket. It further decided that no court costs and no justice fee would be levied.
Art. 181 cpv. 2 LT; withdrawal of the appeal renders the proceedings moot and justifies striking the case from the docket. Where the appeal is withdrawn, the court may terminate the proceedings without entering into the merits and, if so ordered, waive court costs and justice fees.
