tendente a conoscere l’esito di un procedimento penale a carico di un richiedente la naturalizzazione;

premesso che la richiesta è stata presentata direttamente al Ministero pubblico, che l’ha trasmessa per competenza a questa Camera in data 30.3/2.4.2007, preavvisando favorevolmente l’istanza;

richiamate le osservazioni 11/13.4.2007 di PI 2, che precisano la sua situazione personale;

letti ed esaminati gli atti;

considerato

in fatto ed in diritto

  1. A seguito della sua audizione in polizia, PI 2 ha ammesso un limitato consumo di stupefacente. Trattandosi di un caso di poca gravità, il procuratore pubblico ha emanato a suo carico in data 18.4.2006 un decreto di non luogo a procedere (NLP __________) con il quale ha comunicato di non far luogo a procedimento penale ed ha al contempo formalmente ammonito PI 2.

  2. Con la propria istanza, l’Ufficio richiedente ha chiesto di conoscere l’esito del procedimento.

  3. L’art. 27 CPP in vigore dall’1.1.1996, che ha precisato e completato il previgente art. 8 vCPP, con riferimento anche alla giurisprudenza del Tribunale federale (cfr. DTF 110 Ia 83; 95 I 108), stabilisce che: “Oltre ai casi previsti dal presente codice, la Camera dei ricorsi penali può permettere l’ispezione degli atti di un processo e l’estrazione di copie a chi giustifica un interesse giuridico legittimo che prevale sui diritti personali delle persone implicate nel processo, segnatamente su quelli delle parti, del denunciante, dei testimoni e dei periti. La Camera dei ricorsi penali fissa le modalità dell’ispezione.”

  4. Nel presente caso, è di principio dato un interesse giuridico legittimo da parte dell’istante a conoscere l’esito del procedimento, trattandosi di fatti recenti. Le indicazioni contenute nella presente decisione sono sufficienti a rispondere alla richiesta dell’Ufficio istante, senza necessità di trasmettere ulteriori atti.

  5. L’istanza è quindi ammessa ed al contempo evasa con questa decisione. Considerati la natura dell’istante ed il motivo della richiesta, si prescinde dal prelevare una tassa di giustizia e dal chiedere il rimborso di spese.

Per tutti questi motivi,

visto l’art. 27 CPP,

  1. L’istanza è accolta ai sensi dei considerandi.

  2. Non si prelevano tassa di giustizia e spese.
