tendente ad ottenere l’accesso agli atti del procedimento penale relativo ad un incidente stradale del 13.9.2003;

premesso che la richiesta è stata inviata al Ministero pubblico, che l’ha trasmessa per competenza a questa Camera con scritto 30/31.5.2006, mediante il quale ha pure comunicato di non avere obbiezioni all’accoglimento della richiesta;

richiamato lo scritto 12/13.6.2006 del patrocinatore di PI 2, che comunica di non avere osservazioni da formulare;

rilevato che PI 1 non ha presentato osservazioni;

letti ed esaminati gli atti;

considerato

in fatto ed in diritto

1.A seguito di un incidente stradale del 13.9.2003 e di una denuncia penale 18.4.2005, il Ministero pubblico ha aperto un procedimento penale (inc. __________) sfociato in un decreto di non luogo a procedere del 25.4.2006 (NLP __________).

2.Con la presente, la Compagnia di assicurazioni istante chiede di accedere agli atti, per potersi determinare su un suo eventuale obbligo di risarcimento. Come esposto in entrata, le parti interpellate non si sono opposte all’accoglimento dell’istanza.

3.Giusta l’art. 27 CPP – in vigore dall’1.1.1996, che ha precisato e completato il previgente art. 8 vCPP, con riferimento anche alla giurisprudenza del Tribunale federale (DTF 110 Ia 83 e 95 I 108) – "oltre ai casi previsti dal presente codice, la Camera dei ricorsi penali può permettere l’ispezione degli atti di un processo e l’estrazione di copie a chi giustifica un interesse giuridico legittimo che prevale sui diritti personali delle persone implicate nel processo, segnatamente su quelli delle parti, del denunciante, dei testimoni e dei periti. La Camera dei ricorsi penali fissa le modalità dell’ispezione”.

4.Nel presente caso è dato un interesse giuridico legittimo dell’assicurazione istante ad esaminare gli atti, onde potersi determinare su una sua eventuale responsabilità.

5.L’istanza è accolta. La parte istante potrà esaminare gli atti presso il Ministero pubblico, ma non potrà estrarre copie.

6.La tassa di giustizia e le spese, contenute al minimo, sono poste a carico dell’istante.

Per questi motivi,

visto l’art. 27 CPP, sulle spese l’art. 39 lit. f LTG ed ogni altra norma applicabile,

pronuncia

  1. L’istanza è accolta ai sensi dei considerandi.

  2. La tassa di giustizia di CHF 50.-- e le spese di CHF 30.--, per complessivi CHF 80.-- (ottanta), sono poste a carico della IS 1, __________.
