sedente per statuire sull’istanza 5/10.11.2004 presentata dalla

IS 1 ,

tendente ad ottenere l’autorizzazione a ricevere copia della sentenza 23.5.2004 della Corte delle assise correzionali di Lugano;

premesso che l’istanza è stata erroneamente inviata al Tribunale penale cantonale, che ha proceduto correttamente a trasmetterla a questa Camera;

ritenuto che l’istanza era manifestamente non motivata;

conseguentemente questa Camera, con scritto 11.11.2004, ha assegnato alla Compagnia d’assicurazione istante un termine di 10 giorni per precisare le ragioni della richiesta, sotto comminatoria di stralcio dai ruoli;

considerato che il termine è trascorso infruttuoso, senza che sia stato dato seguito alla richiesta di questa Camera;

di conseguenza si procede a stralciare dai ruoli l’istanza, con carico di tassa di giustizia e spese a chi le ha provocate.

Per questi motivi,

visti gli art. 27 CPP, l’art. 39 lit. f LTG ed ogni altra norma applicabile,

decreta

  1. L’istanza è stralciata dai ruoli.

  2. La tassa di giustizia di CHF 70.-- e le spese di CHF 30.--, per complessivi CHF 100.-- (cento), sono poste a carico della IS 1, __________.
