statuendo sul ricorso 13 ottobre 2005 di

RI 1

contro

la decisione 28 settembre 2005 (n. 4612) del Consiglio di Stato;

letti ed esaminati gli atti;

ritenuto e considerato in fatto e in diritto

che con citazione del 26 agosto 2005 il Servizio dei ricorsi del Consiglio di Stato ha convocato RI 1 ad un sopralluogo nell'ambito di due procedure di ricorso che la vedono coinvolta quale parte dinanzi all'Esecutivo cantonale;

che RI 1 ha impugnato il provvedimento davanti al Consiglio di Stato;

che l'Esecutivo cantonale ha dichiarato irricevibile il gravame interposto dalla ricorrente contro la citazione siccome inoltrato contro una decisione incidentale ed inappellabile;

che contro il giudizio governativo RI 1 insorge ora davanti al Tribunale cantonale amministrativo, chiedendone implicitamente l'annullamento;

che la competenza di questo tribunale (art. 21 LE), la legittimazione della ricorrente (art. 43 PAmm) e la tempestività del gravame (art. 46 cpv. 1 PAmm) sono certe;

che giusta l'art. 48 PAmm, l'autorità di ricorso può, immediatamente o dopo richiamo degli atti, decidere con breve motivazione di respingere il ricorso se esso si riveli inammissibile o manifestamente infondato;

che le decisioni incidentali possono essere impugnate soltanto se provocano al ricorrente un danno altrimenti irreparabile (art. 44 PAmm);

che in concreto la citazione al sopralluogo costituisce una semplice decisione incidentale di carattere interlocutorio;

che questo atto non è suscettibile di compromettere in alcun modo gli interessi della ricorrente, che potrà se del caso impugnare il giudizio reso nel merito della vertenza dal Consiglio di Stato;

che, stante quanto precede, il ricorso va dunque respinto;

che la tassa e le spese di giustizia seguono la soccombenza.

Per questi motivi,

visti gli art. 18, 28, 43, 46, 48, 60, 61 PAmm;

dichiara e pronuncia:

  1. Il ricorso è respinto.

  2. La tassa di giustizia e le spese, di complessivi fr. 100.–, sono a carico della ricorrente.
