la decisione 30 agosto 2005, n. 4158, del Consiglio di Stato, che respinge il ricorso interposto dall'insorgente avverso la decisione 16 dicembre 2004 del comune di CO 1 che gli nega la licenza edilizia per la ristrutturazione dell'edificio posto al mappale no. 107 RFD;

preso atto che con scritto 28 settembre 2005 il patrocinatore del ricorrente ha comunicato di ritirare il ricorso;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.
