Zusammenfassung

Two appeals against a State Council decision concerning the annulment of a building permit were filed before the Ticino Administrative Court. At the site inspection hearing, the appellants stated that they were withdrawing their appeals. The court therefore struck both proceedings from the docket and ordered that no fees or costs be taken.

Appeal withdrawal in administrative planning proceedings; once the appellants expressly withdraw their remedies, the court no longer adjudicates the merits and strikes the cases from the docket (consid. implicit). In such a situation, the proceedings are terminated without a decision on the challenged permit or on the underlying administrative appeal. Where the withdrawal leads to the exhaustion of the proceedings, no court fees or expenses are levied absent an express contrary basis.
