The appellant challenged the Cantonal State Council's decision confirming the municipality's refusal of a building permit for a vinification depot and parking space. At the site inspection hearing on 18 March 1999, the appellant declared that she was withdrawing the appeal under the terms stated in the minutes. The Administrative Court held that the proceedings were thereby exhausted, struck the case from the docket, and ordered that no court fees or expenses be charged.

statuendo sul ricorso 4 marzo 1998 di

contro

la decisione 18 febbraio 1998, no. 700, del Consiglio di Stato che respinge l'impugnativa presentata dall'insorgente avverso la decisione 28 ottobre 1997 con cui il municipio di __________ le ha negato la licenza edilizia per la costruzione di un deposito per la vinificazione e di un posteggio in località __________ (part. no. __________ RFD);

preso atto che in occasione dell'udienza di sopralluogo 18 marzo 1999 la ricorrente ha dichiarato di ritirare il ricorso come alle condizioni menzionate a verbale;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.
