Zusammenfassung

The appellant challenged the Cantonal Government’s decision upholding the revocation of his driving licence by the Department of Institutions, Traffic Section. Before the administrative court could decide the merits, the appellant’s lawyer notified the court that the appeal was withdrawn. The court therefore struck the case from the roll and ordered that no court fees or expenses be taken.

Withdrawal of appeal; striking off the roll. Where the appellant withdraws the remedy, the court takes note of the withdrawal and terminates the proceedings without a merits review. In the absence of a substantive decision, no court fees or expenses are imposed if the court so orders (consid. 1-2).

la decisione 21 gennaio 1998, no. 216, del Consiglio di Stato che respinge l'impugnativa 29 ottobre 1997 presentata dall'insorgente avverso la decisione 23 ottobre 1997 con cui il Dipartimento delle istituzioni, Sezione della circolazione gli ha revocato la licenza di condurre;

preso atto che in data 11 febbraio 1998 il patrocinatore del ricorrente ha comunicato di ritirare il ricorso;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.
