statuendo sul ricorso 10 dicembre 1998 del

contro

la decisione 25 novembre 1998, no. 5419, del Consiglio di Stato che annulla il contributo sostitutivo per posteggi mancanti imposto dal municipio di __________ a titolo di condizione della licenza 14 agosto 1998 rilasciata dal municipio di __________ ad __________, __________, __________ ed __________ per l'ampliamento del __________ (part. no. __________ RFD);

preso atto che in occasione dell’udienza di sopralluogo 23 marzo 1999, dopo discussione, il Giudice Delegato ha proposto alle parti di comporre la vertenza mediante versamento di un contributo sostitutivo per posteggi mancanti dell'importo di fr. 10'000.--;

ritenuto che con comunicazioni 26 e 29 marzo 1999 il comune di __________ rispettivamente il patrocinatore delle controparti hanno aderito alla proposta transattiva di cui sopra;

considerato pertanto che il procedimento è così esaurito lo stesso viene stralciato dai ruoli secondo le modalità del verbale di sopralluogo;

decreta:

  1. Il ricorso è stralciato dai ruoli per intervenuta transazione.

§. La decisione 25 novembre 1998, no. 5419, del Consiglio di Stato è annullata e riformata di conseguenza.

  1. Non si prelevano tasse di giustizia e non si assegnano ripetibili nè di prima, nè di seconda istanza.
