Zusammenfassung

The appellant challenged a State Council decision concerning a building permit. During the proceedings, the appellant died. On 28 May 1998, the members of the hereditary community notified the court that they were withdrawing the appeal. The Administrative Court therefore considered the proceedings exhausted, struck the appeal from the docket, and ordered that no court fees or costs be levied.

la decisione 15 gennaio 1998, no. 116, del Consiglio di Stato che accoglie il ricorso 4 novembre 1997 del Dipartimento del territorio, interposto contro la licenza edilizia 14 ottobre 1997 rilasciata dal municipio di __________ all'insorgente;

rilevato che nelle more della procedura l'insorgente è nel frattempo deceduta;

preso atto che in data 28 maggio 1998 i membri della Comunione ereditaria fu __________ hanno comunicato di ritirare il ricorso;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.
