Zusammenfassung

The Ticino Administrative Court dealt with an appeal against a State Council decision remanding a building matter to the municipality of Porza. Before adjudication, the appellant withdrew the appeal on 22 July 1997. The court therefore held that the proceedings were exhausted, struck the case from the docket, and ordered that no court fees or costs be charged.

Where the appellant withdraws the remedy before judgment, the court need not rule on the merits and may dispose of the matter by striking it out; in the absence of a contrary basis, no court fees or expenses are levied.

la decisione 15 luglio 1997, no 3575, del Consiglio di Stato, che rinvia gli atti al municipio di Porza per nuova decisione in materia edilizia;

preso atto che in data 22 luglio 1997 il ricorrente ha comunicato di ritirare il ricorso;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.
