la decisione 24 gennaio 1995, no. 526, del Consiglio di Stato che respinge il ricorso 15 novembre 1994 dei signori __________ e , contro la decisione 4 novembre 1994 del municipio di __________ con la quale si ordina l'esecuzione di determinate misure di sicurezza antincendio nell'esercizio pubblico "", sito al mappale no. __________ RFD di __________;

preso atto che in occasione dell’udienza di sopralluogo del 27 ottobre 1995, dopo ampia discussione, il Giudice Delegato ha sottoposto alle parti la seguente transazione:

"1. Il signor __________ si impegna entro 3 mesi da oggi a realizzare un'impianto automatico di rilevazione di incendio con sorveglianza totale dei locali del __________ e di tutti i locali delle due vie di fuga: scala principale e uscita attraverso l'autorimessa, secondo le norme in vigore comprese l'autorimessa __________ e l'autorimessa __________.

  1. La porta scorrevole che chiude l'autorimessa __________ deve essere dotata di un comando asservito all'impianto rivelatore d'incendio per garantire un'apertura automatizzata in caso di bisogno.

  2. Il Dipartimento d'intesa con le autorità comunali procederanno al collaudo dell'impianto.

  3. Il ricorrente dichiara di ritirare il gravame per cui il Tribunale cantonale amministrativo procederà allo stralcio della causa senza spese e tassa di giustizia."
