Zusammenfassung

The applicant appealed a State Council decision confirming a CHF 2,500 pecuniary sanction imposed by a municipality. Before the administrative court could decide the merits, counsel informed the court on 11 September 1998 that the appeal was withdrawn. The court therefore struck the appeal from the roll and ordered that no court fees or costs be taken.

Appeal withdrawn; proceedings become moot and are struck from the roll. Where the appellant withdraws the remedy, the administrative court does not examine the merits and terminates the proceedings by removing the case from the docket. In the absence of a merits decision, no court fees or party costs are levied if the court so orders in view of the termination of the procedure.

la decisione 17 luglio 1995, no. 3941, del Consiglio di Stato che accoglie l'impugnativa 27 marzo 1995 del Dipartimento del territorio, Sezione della pianificazione urbanistica, interposta contro la risoluzione 10 marzo 1995 del municipio di __________, con la quale infliggeva a __________, una sanzione pecuniaria di fr. 2'500;

preso atto che in data 11 settembre 1998 il patrocinatore della ricorrente ha comunicato di ritirare il ricorso;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.
