statuendo sul ricorso 13 gennaio 1998 del

Comune di __________

contro

la decisione 16 dicembre 1997 del Tribunale di espropriazione della giurisdizione sopracenerina concernente l'esproprio del mapp. __________ di __________;

preso atto che in occasione dell’udienza di sopralluogo 16 ottobre 1998, dopo ampia discussione, il Giudice Delegato ha sottoposto alle parti la seguente transazione:

"1. Il comune di __________ si impegna a limitare l'espropriazione formale del mapp. __________ di proprietà __________ alla ghiacciaia sub A ed al terreno circostante marcati in arancione nella planimetria allegata al ricorso 13.1.98.

  1. A queste condizioni il signor __________ ritira l'opposizione all'esproprio e aderisce al ricorso che il comune ha inoltrato al Tribunale cantonale amministrativo.

  2. Gli atti vengono retrocessi al Tribunale di espropriazione per la fissazione delle indennità espropriative dovute al proprietario.

  3. In caso di accettazione il Tribunale cantonale amministrativo stralcerà la causa dai ruoli senza prelevare tassa di giustizia e senza assegnazione di ripetibili."

rilevato che le parti hanno aderito seduta stante alla proposta succitata;

considerato pertanto che il procedimento è così esaurito,

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.
