In an expropriation appeal, the cantonal administrative court proposed a settlement during the site inspection hearing. The inheritance community and the municipality both accepted the proposal in writing. The court therefore held the proceedings to be concluded and struck the appeal from the docket. In accordance with the settlement terms, no court fees or costs were charged.
Proceedings before the administrative court may be terminated by settlement when both parties accept the court’s proposal; in that event the matter is struck from the docket. Where the settlement expressly provides for waiver of judicial fees and costs upon acceptance, no such costs are levied once the agreement is concluded.

la decisione 27 settembre 1994 del Tribunale di espropriazione della giurisdizione sottocenerina
preso atto che in occasione dell’udienza di sopralluogo, dopo ampia discussione, il Giudice Delegato ha proposto alle parti la seguente transazione:
"1. Per l'espropriazione formale di ca. 92 mq del mapp. no. __________il Comune di __________e verserà un'indennità di fr. 320.-- il mq oltre interessi:
del 5,5 % dal 5 luglio 1993 al 30 settembre 1993
del 5 % dal 1° ottobre 1993 in avanti.
In caso di transazione il Tribunale cantonale amministrativo rinuncerà al prelievo di spese e tassa di giudizio.
Alle parti è fissato un termine di 15 giorni per pronunciarsi sulla suddetta proposta.
In caso di mancata accettazione il Tribunale cantonale amministrativo emanerà il proprio giudizio senza ulteriori formalità."
rilevato che con comunicazione 16 febbraio 1995, sia la ricorrente che il municipio hanno accettato la transazione succitata;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano tasse e spese.
