The Ticino Cantonal Insurance Court, after having dismissed the underlying accident-insurance appeal and granted legal aid to the appellant, ruled on the lawyer's submitted fee note. The president taxed the note at CHF 1,688.75 including VAT, ordered that no justice fee be collected, and placed the costs on the State. The order also stated that both counsel and the Department of Institutions could appeal the taxed amount to the Council of Moderation within 15 days.
Art. 21 Legge di procedura 6.4.61; taxation of counsel fees in legal-aid matters. Where legal aid has been granted, the court may tax the submitted fee note ex officio on the basis of the file and determine the compensable amount, including VAT where applicable. In such taxation proceedings, no justice fee is levied and the expenses may be borne by the State. The taxed amount is subject to a specific remedy by counsel and the competent administrative department within the statutory time limit (consid. 1-3).

visto in particolare l'art. 21 della Legge di procedura 6.4.61;
ordina 1. La nota è tassata in fr. 1'688.75 (IVA inclusa);
Non si percepisce tassa di giustizia, mentre le spese sono poste a carico dello Stato.
Contro l'ammontare dell'onorario il patrocinatore e il Dipartimento delle Istituzioni possono ricorrere entro 15 giorni al Consiglio di moderazione.
