Zusammenfassung

The president of the Ticino Insurance Court ruled on the taxation of a lawyer’s fee note following a successful appeal and grant of legal aid. Relying on Art. 21 of the Cantonal Procedural Law, the court taxed the note at CHF 1,203, waived the justice fee, and charged the costs to the State. It also indicated that both the counsel and the Department of Institutions could appeal the amount within 15 days to the Council of Moderation.

Art. 21 Legge di procedura 6.4.61; taxation of the fee note of court-appointed counsel after grant of legal aid. The deciding authority assesses the submitted honorarium ex officio on the basis of the applicable procedural rules and may fix the amount by order. In such taxation proceedings, the court may waive the justice fee and allocate procedural expenses to the State. The amount fixed is subject to the special remedy provided by cantonal law within the stated time limit (consid. 1-3).

vista la sentenza 18 ottobre 2001 con la quale è stato respinto il gravame ed è stata posta la parte ricorrente al beneficio dell'assistenza giudiziaria;

rilevato che in data 1 ottobre 2001 l'avvocato __________ ha trasmesso l'allegata nota d'onorario per la tassazione;

visto in particolare l'art. 21 della Legge di procedura 6.4.61;

ordina 1. La nota è tassata in fr. 1'203.--;

  1. Non si percepisce tassa di giustizia, mentre le spese sono poste a carico dello Stato.

  2. Contro l'ammontare dell'onorario il patrocinatore e il Dipartimento delle Istituzioni possono ricorrere entro 15 giorni al Consiglio di moderazione.
